South Carolina is one of the states where "do I need a business license?" has two answers at once. The state itself issues no general licence, yet almost every city and many counties charge a business license tax, and since 2022 they all follow one standardized set of rules. This guide explains how those local licences work under Act 176, how the tax is worked out from your gross income, the April 30 renewal, the SCDOR retail license for sellers, state licences for contractors and other trades, and what Columbia and Charleston ask for. Every figure was checked with the agency concerned in October 2026.

Quick answer

South Carolina has no general state business license. Instead, most cities and many counties require a local business license, which is a tax on your gross income renewed every year by April 30 under Act 176. If you sell taxable goods, you also need a $50 SCDOR retail license for each location, and regulated trades need a state licence from LLR.

  • Local licence year runs May 1 to April 30 everywhere in the state

  • Tax = base amount + rate per $1,000 of gross income, set by your NAICS rate class

  • Renew every city and county at once on the Local Business License Renewal Center

  • General contractors need a state licence for jobs over $10,000

Is there a state business license in South Carolina?

No. The state's own Business One Stop portal says plainly that South Carolina does not have a statewide business license. What it has instead is three separate layers, and most businesses touch at least two of them.

The first layer is local. Business licences are issued by counties and municipalities, and although not every one of them requires a licence, most do. Some businesses need both a city licence and a county licence. The second layer is tax registration with the South Carolina Department of Revenue (SCDOR): a retail license if you sell taxable goods, plus withholding and other accounts if they apply. The third layer is professional and occupational licensing by state boards, most of them under the Department of Labor, Licensing and Regulation (LLR), along with permits from agencies such as the Department of Agriculture for food.

Forming an LLC or corporation with the Secretary of State is a fourth step, but it is registration of the entity, not a licence to operate. Our South Carolina LLC guide covers that filing, which costs $110.

Local business licenses under Act 176

Until 2022, every South Carolina city wrote its own business licence rules. Due dates, classes, definitions of income and appeal rights all varied, which was painful for anyone working across several towns. The Business License Tax Standardization Act, passed in 2020 as Act 176 and codified at SC Code sections 6-1-400 to 6-1-420, changed that from January 1, 2022. Any county or municipality that levies a business license tax must now follow the same framework.

The main rules are:

  • One licence year. Every licence covers the twelve months from May 1 to April 30, and renewals are due before May 1. The only exception in the statute is a licence for a single construction project, which can run until the project is finished.
  • One tax base. The tax is calculated on gross income for the previous calendar or fiscal year. A business that has operated for less than a year uses an estimate of its gross income for the rest of the licence year.
  • One class system. Every business is placed in a rate class based on its NAICS industry code, using IRS profitability statistics. The Municipal Association of South Carolina updates the standard class schedule, and each city and county must adopt the latest one by ordinance by December 31 of every odd-numbered year.
  • One application. Jurisdictions must accept the standardized business license application, which is useful if you work in several towns.
  • One online renewal portal. Every licensing jurisdiction must give access to the state-hosted portal, the Local Business License Renewal Center.

The most recent update was adopted during 2025. The Municipal Association says cities had to adopt the new class schedule by December 31, 2025, and it applies to the licence years May 1, 2026 to April 30, 2027 and May 1, 2027 to April 30, 2028. That means your rate class may have moved up or down for the 2026 licence year even if your business did not change. Charleston, for example, tells renewing businesses that its fee schedule was adjusted and that a business may move to a higher or lower class.

What counts as gross income

Gross income for the licence tax means gross receipts or revenue from business done within the city or county. A business based in a city may have to include income earned elsewhere, but only where that income is not already taxed by another jurisdiction and is reported. Taxes you collect on behalf of a government, such as sales tax, are excluded, as are escrow funds and property held for third parties. Wholesalers are exempt unless they keep a warehouse or distribution site in the jurisdiction. Insurers pay on premiums written, and insurance agents on the commissions they keep.

Refunds of overpaid tax must be requested before June 1, and the jurisdiction must pay within thirty days. That matters if you estimated high in your first year.

How the local license tax is calculated

A South Carolina business licence is a tax, not a flat permit fee, so the cost grows with your sales. Each class has two numbers: a base amount on the first slice of gross income, and a rate for each additional $1,000 or part of $1,000. Most cities follow the model ordinance published by the Municipal Association, which also scales down the per-$1,000 rate for income above $1 million and doubles the rates for non-residents and itinerant businesses with no fixed place of business in the town.

The Town of Chapin, near Columbia, publishes its 2026 schedule in full, so it makes a useful illustration. The figures below are Chapin's. Your own city's base amounts and rates will differ, but the structure is the same.

ClassTypical sectors (NAICS)Base on first $2,000Per $1,000 over $2,000
1Retail trade, wholesale, accommodation, agriculture$30$1.00
2Restaurants and bars, transportation$35$1.05
3Manufacturing, health care, personal and repair services$40$1.10
4Professional, scientific and technical services, information$45$1.15
6Real estate and rental$55$1.25
7Finance and insurance, management of companies$60$1.30
8Special subclasses set by statute (telecoms, insurers, amusement machines and others)VariesVaries

Classes are assigned by sector, so a boutique and a hardware store land in the same class, while an accountant sits several classes higher because the IRS data shows professional services are more profitable per dollar of revenue.

Two worked examples

A gift shop with $250,000 of sales. Retail is Class 1. Under Chapin's schedule the tax is $30 on the first $2,000 plus $1.00 for each of the remaining 248 thousands, which comes to $278 for the year. Sales tax collected from customers is left out of the gross income figure.

A web developer billing $120,000. Professional services are Class 4: $45 plus 118 × $1.15, which is $180.70. If the same developer were based in another town and only did a job in Chapin, the non-resident rule in the model ordinance would double the rate, and the tax would be worked out on the income from that job.

Larger cities usually have a higher base income bracket and higher base amounts than a small town, so treat these numbers as a demonstration of the method, not a quote for Columbia or Greenville. Every city must publish its ordinance, and the licensing office will tell you your class over the phone.

Renewal, penalties and appeals

Renewal is due by April 30 each year, based on the gross income you earned in the previous year. Cities usually mail a renewal notice in the spring, but not receiving one does not extend the deadline.

The penalty for paying late is set by each local ordinance. The model ordinance most cities use charges 5% of the unpaid tax for each month or part of a month after the due date, and says penalties cannot be waived. A partial payment stops penalties from building on the part you have paid. Charleston is an example of a city with its own timing: it treats the fee as due on May 1 and payable by May 31, then adds cumulative penalties if you miss that date.

If a city thinks you owe more, section 6-1-410 sets out a fixed process. The licensing official serves a notice of assessment. You have thirty days to ask in writing for an adjustment, which leads to an informal conference and then a final assessment. You can appeal the final assessment to the city council or its appeals board within thirty days by paying at least 80 percent of the tax assessed, and from there to the Administrative Law Court. Section 6-1-420 also limits what private collection firms hired by cities can do: they can find unlicensed businesses and ask them to pay, but they cannot assess tax or demand your confidential records.

The Local Business License Renewal Center

Act 176 required a single online portal for renewals, and the result is the Local Business License Renewal Center at localblrenewal.com, run with the Municipal Association. You create one account, enter each address where you do business, and the portal shows which participating cities and counties license that location. You can then renew all of them in one session and pay once. The portal is for renewals; to get a licence for the first time, you apply to each city or county directly. Cities must also continue to accept payment in person, by phone, by mail and through any system they already had, so you are not forced online.

The SCDOR retail license and other state tax licences

If you sell tangible goods at retail, South Carolina requires a retail license from the Department of Revenue before you start. It is the state sales tax registration, and it is separate from your city licence. The fee is $50, non-refundable, and you need one for each business location. Once issued, the licence does not expire, so there is nothing to renew as long as the same owner keeps trading. If you move, update your address in MyDORWAY. A licence must be surrendered after 24 months in a row without sales.

You apply through the Business Tax Application on MyDORWAY, SCDOR's online portal, and pay the fee as part of the application; it is not processed until payment arrives. The same application registers you for withholding if you have employees.

Maximum Tax LicenseSellers of aircraft, motor vehicles, boats, trailers, RVs and similar items capped at $500 of tax$50
Accommodations tax licenseHotels, campgrounds and others renting rooms or spaces to guests$50
Admissions tax licenseVenues charging admissionNo fee

Once licensed you collect the state rate of 6% plus any local sales taxes, which bring Charleston to 9% and the Richland County part of Columbia to 8%. Returns are due by the 20th of the following month. Our South Carolina sales tax guide lists rates by county and explains the timely-filing discount. Restaurants should also ask their city about a local hospitality tax on prepared food, which cities collect themselves rather than through SCDOR.

Out-of-state sellers with no physical presence register only once their sales into South Carolina pass more than $100,000 in the current or previous year, and sales made through a marketplace that collects the tax for you do not count toward your own obligation.

State professional and trade licences

Many occupations need a state licence before you can work, regardless of your city licence. Most are administered by boards within LLR. Examples include cosmetology and barbering, real estate, accountancy, pharmacy, engineering and surveying, and the building trades.

Construction is where people most often get the threshold wrong. Under section 40-11-30, a general or mechanical contractor needs a licence from the Contractor's Licensing Board when the total cost of the work is more than $10,000. The threshold was $5,000 until 2023 Act 69 raised it, and many websites still show the old figure. Residential work has its own rules under section 40-59-20: a residential builder licence from the Residential Builders Commission is needed for jobs of $5,000 or more, and a residential specialty contractor, such as a roofer, painter or flooring installer, must register for jobs over $500.

Contractors also deal with local licences in every town where they work. Most cities license out-of-town contractors per job or require a licence before they issue a building permit. Charleston, for instance, does not let itinerant contractors apply or renew online; they apply in person, by mail or by email, listing the project address and job value.

Food businesses changed regulators recently. Since July 1, 2024, retail food establishment permits, including those for restaurants, food trucks and many retail food sellers, have been issued and inspected by the South Carolina Department of Agriculture rather than DHEC, which was split into two agencies that year. You need the permit before selling food directly to consumers. Alcohol needs a separate permit from SCDOR's alcohol beverage licensing section.

Columbia and Charleston: what the two largest cities ask for

Columbia. The City of Columbia requires every person engaged in any business, occupation or profession, wholly or partly within city limits, to obtain a business licence and pay the annual licence tax. Its Business License Division sets out the order of steps. First, check your address on the city's GIS map, because the Columbia area includes several licensing jurisdictions and an address with a Columbia mailing address may sit in Forest Acres, Cayce or unincorporated Richland County instead. Second, confirm with zoning that your activity is allowed at the site. Third, register with SCDOR on MyDORWAY. Fourth, get an EIN and register your entity with the Secretary of State. Only then do you apply, online through the city's self-service portal, by emailing the fillable application, or in person on Main Street.

Your application may need clearance from zoning, building inspection, the fire marshal, the health regulator and engineering, and the city may schedule inspections before the licence is finalized. For emailed applications, the division says to allow up to five business days for a licensing technician to contact you. The same division also handles Columbia's hospitality tax account for restaurants, plus special event and busker permits.

Charleston. The City of Charleston's Revenue Collections Division issues licences and runs renewals through its online self-service system, with in-person service at the Permit Center on George Street and payment by mail. Licences are not transferable: if you buy an existing business, you apply for a new licence in your own name. If you closed a business during the year, file the city's cancellation form with your final renewal so the account is closed. If you plan to rent out property to visitors, check the city's zoning and short-term rental rules before you list it, because a business licence alone does not authorize the use.

Business names, entities and employers

South Carolina has no general statewide register of trade names for sole proprietors, so there is no state "DBA" form to file in most cases. Your trading name goes on your local business licence application and your SCDOR registration, and your bank will want to see it there. If you want legal protection for a brand, register it as a state or federal trademark. LLCs and corporations register their legal names with the Secretary of State when they form. Our DBA guide compares how trade names work in other states.

Owners of pass-through businesses can elect to pay a 3% rate on active trade or business income. Employers register for withholding with SCDOR and for unemployment insurance with the Department of Employment and Workforce, and our guide to hiring your first employee covers the federal side.

Common mistakes and how to fix them

The first mistake is thinking the retail license is the business licence. The SCDOR licence is a sales tax registration. It does nothing for your city or county obligation, and cities do find unlicensed businesses through state records and third-party collectors. If you have been trading without a local licence, contact the licensing office, ask for your class, and pay the back years before an assessment arrives; penalties keep building every month.

The second is paying the wrong jurisdiction. Mailing addresses do not follow municipal boundaries. Look up the address on the city or county GIS map, or enter it on the renewal centre, before applying. A business inside city limits normally needs the city licence; one in an unincorporated area may need a county licence instead.

The third is under-reporting gross income. The licence tax is based on gross receipts, not profit, so don't use your net income figure. Do subtract sales tax collected from customers, which the statute excludes.

The fourth is forgetting that your class may have changed. Because cities adopted a new class schedule for the 2026–27 licence year, last year's figure may not be this year's. Check your renewal notice for the class.

The fifth applies to contractors: quoting from an outdated threshold. General contractors need a state licence above $10,000, and residential specialty contractors must register above $500. Working unlicensed exposes you to LLR penalties and can complicate collecting payment for the job.

What to do next

Decide your structure with our South Carolina LLC guide, check the name with the LLC name checker, and get an EIN. If you sell goods, register for the retail license on MyDORWAY and use our South Carolina sales tax guide and sales tax calculator to charge the right local rate. Then call your city or county licensing office, confirm your class, and put April 30 in your calendar every year. Frequently asked questions

No. South Carolina has no general statewide business license. Most cities and many counties levy a local business license tax, and since 2022 they all follow the standardized rules in Act 176. Separately, anyone selling taxable goods needs a $50 retail license from the Department of Revenue, and regulated trades such as contractors, cosmetologists and real estate agents need a state licence from LLR.
