Pennsylvania is one of the many states with no general business licence. You will not find a single state form that lets you open for business. Instead, the state asks you to register for the taxes you will collect, record any trade name, and get licensed only if your work is regulated. Then your municipality, whether a city, borough or township, may add its own registration, taxes and permits. This guide sets out each layer, what it costs in 2026, and how Philadelphia and Pittsburgh handle the local part. For the full Philadelphia picture, read our Philadelphia business license guide. Figures were checked with each agency in October 2026.

Quick answer

Pennsylvania has no general business license. Most businesses need some mix of: a sales tax license from the Department of Revenue through myPATH if they sell taxable goods or services, a fictitious name registration ($70) if they trade under a made-up name, a board licence for regulated professions, and local registrations from their municipality.

  • Sales tax license: apply in myPATH before your first taxable sale; renews every five years

  • LLC certificate of organization: $125; annual report $7

  • Home improvement contractors doing $5,000+ a year register with the Attorney General

  • Philadelphia's Commercial Activity License is free; Pittsburgh uses a city registration form

Does Pennsylvania have a state business license?

No. Pennsylvania's Business One-Stop Shop states that there is no general business licence that all Pennsylvania businesses must obtain. Licensing depends on two things: what the business does and where it is located. The Department of State, which registers companies and fictitious names, says it does not issue business licences at all, and tells owners to contact their county, township, city or borough for any local requirement.

That means the phrase "Pennsylvania business license" usually refers to one of four things. The first is the sales tax license, the closest thing the state has to a general permit for retailers. The second is a name or entity filing with the Department of State. The third is a professional or occupational licence from one of the state's boards. The fourth is whatever your municipality requires, which can range from nothing to a full licence plus several local taxes.

The One-Stop Shop's licence guide is worth bookmarking. It lists state licences by agency and activity, from home improvement contractor registration with the Attorney General to Liquor Control Board licences for wineries and breweries, and includes the two county-level licences it highlights: security businesses such as private detectives and guard agencies, licensed through the Clerk of Courts of Common Pleas, and precious metal dealers, licensed through the sheriff.

An EIN from the IRS is free and needed by entities and employers. Employers also register for state withholding through myPATH and for unemployment compensation with the Department of Labor and Industry.

The Pennsylvania sales tax license

For retailers, restaurants and many service businesses, this is the licence that matters. The Department of Revenue's Retailer's Information Guide (REV-717) says that every person, partnership, corporation or other entity making taxable sales of goods or services must obtain a Sales Tax license, and that includes out-of-state retailers whose gross sales into Pennsylvania passed $100,000 in the previous year. Leasing goods and renting hotel rooms count as sales too. Failing to be licensed can bring a fine.

You apply before your first taxable sale through the Pennsylvania Online Business Tax Registration service in myPATH, which replaced the old paper PA-100 enterprise registration form. The same registration covers employer withholding and several other state taxes. Revenue's guide lists no application fee. If you have more than one place of business in Pennsylvania, a copy of the licence must be displayed at each location.

The licence renews automatically every five years, but only if you have filed every required Pennsylvania return and paid every Pennsylvania tax. Revenue will not issue or renew a licence for a business that is behind, so a missed zero return can leave you selling without a valid licence at renewal time. Separate licences exist for transient vendors who sell at shows and markets without a permanent Pennsylvania location, for promoters of those shows and for booking agents.

Pennsylvania taxes fewer services than New York, but some are taxable, including building maintenance and cleaning, lawn care, and disinfecting or pest control services. Once licensed, you collect 6% statewide, 7% in Allegheny County and 8% in Philadelphia. Our Pennsylvania sales tax guide covers what is taxable, filing frequency and the vendor discount.

Fictitious names: Pennsylvania's DBA

Pennsylvania calls a DBA a fictitious name, and unlike many states it registers them centrally with the Department of State rather than with counties. Any individual, partnership, LLC, corporation or other association doing business under a name other than its proper name must register it, using form DSCB:54-311, for $70. The form asks for the name, a short description of the business, the principal place of business (a P.O. box alone is not accepted) and every person or entity with an interest in the business.

The own-name rule is stricter than people expect. An individual trading under their full proper name, such as "John Kowalski", does not register. "Kowalski Plumbing" generally is fictitious because it does not clearly identify him as the owner, and the Department of State specifically says that adding words such as "& Sons" or "& Associates" makes a name fictitious. A sole proprietor may use "Company" without that alone triggering registration.

Advertising applies only when an individual is listed as one of the parties on the form. In that case you advertise in two newspapers of general circulation in the county where the business is located, one of which must be a legal newspaper; if the county has only one general-circulation paper, that is enough. You keep the proof of publication with your records rather than sending it in. A business owned entirely by an LLC or corporation does not advertise its fictitious name.

Skipping registration has a specific cost. An unregistered business cannot use Pennsylvania courts to enforce a contract made under the fictitious name until it registers, and a court can then impose a $500 penalty. The contract itself is not void. Registration gives no exclusive right to the name and is not a trademark; check the Department of State's records and run our LLC name checker first. Our DBA guide compares other states.

Forming an LLC or corporation

Forming an entity is optional, but many owners do it for liability protection. An LLC files a certificate of organization with the Department of State for $125, and articles of incorporation cost the same. Since 2025, LLCs and corporations file an annual report for $7; for LLCs it is due by September 30. The Department of State has said that from 2027 entities that fail to file can be administratively dissolved, so diary the date even though the fee is small. Our Pennsylvania LLC guide covers the docketing statement, registered office options and reinstatement fees.

Professional and trade licences

Regulated work is where Pennsylvania's licensing really happens. The Department of State's Bureau of Professional and Occupational Affairs supports 29 licensing boards and commissions, each with its own statute. They cover professions such as accountancy, architecture, engineering, nursing, medicine and real estate, and trades such as cosmetology, barbering, auctioneering and vehicle dealing. Other agencies license other fields: the Liquor Control Board for alcohol, the Department of Agriculture or a local health department for food businesses, and the Department of Human Services for child care.

Construction is the notable exception. Pennsylvania has no statewide general contractor licence. Instead, the Home Improvement Consumer Protection Act requires contractors who perform $5,000 or more of home improvement work a year to register with the Attorney General's Bureau of Consumer Protection. Registrations last two years, and the contractor must show the registration number on contracts and advertising, including vehicles, and carry minimum insurance. Home improvement contracts over $500 must be in writing. The registration fee is set by the Attorney General; check the current amount on its registration page before applying. Electricians, plumbers and builders often need municipal licences on top, especially in Philadelphia and Pittsburgh.

Local rules: Philadelphia, Pittsburgh and everywhere else

Pennsylvania has thousands of municipalities, and local rules vary more than state rules. Many municipalities levy taxes under the Local Tax Enabling Act, such as an earned income tax, the per-worker Local Services Tax, and in some places a business privilege or mercantile tax with its own registration or licence. Most also enforce zoning, building permits and certificates of occupancy, and some license specific activities such as peddling, rental housing or amusement devices.

Philadelphia is the most demanding. Every business needs a Commercial Activity License, which is free, and a Business Income and Receipts Tax account; the city also levies the Net Profits Tax and Wage Tax. Our Philadelphia business license guide has the current rates and filing dates.

Pittsburgh asks new businesses to file the Department of Finance's Business Registration Form, which creates a city account with a nine-digit number. The form lists the city taxes a business may owe or collect: the Local Services Tax, the Payroll Expense Tax on employers, the Amusement Tax, the Parking Tax and, for non-profits, the Institution and Service Privilege Tax. Employer withholding for the earned income tax is registered separately with Jordan Tax Service, the area's Act 32 collector. You submit the form by email or post to the Department of Finance.

Elsewhere, call your borough or township office before you sign a lease. Ask whether it has a business privilege or mercantile tax, whether a home occupation needs a zoning permit, and whether your activity needs a local licence.

Worked examples: first-year costs

These examples use state figures checked in October 2026 and leave out optional extras such as legal help or commercial registered office services.

A freelance graphic designer in State College, sole proprietor. She works under her own name and sells only design services, which are not taxable in Pennsylvania, so she needs no fictitious name and no sales tax license. Her borough may still levy local taxes on her earnings, so she checks with the borough office. State licensing cost: $0.

A coffee roaster in Lancaster, single-member LLC. The owner forms "Red Rose Roasting LLC" for $125 and trades as "Red Rose Coffee", registering that fictitious name for $70. Because the LLC is the only party listed, no newspaper advertising is required. Retail sales of prepared coffee drinks are taxable, so she registers for the sales tax license in myPATH, then obtains a food facility licence and the city's zoning and occupancy approvals. State filing costs: about $195, plus the $7 annual report the following year.

A remodeler in the Pittsburgh suburbs, sole proprietor. He trades as "Kowalski & Sons Remodeling", so he registers the fictitious name for $70 and advertises it in two Allegheny County papers, including the legal journal. He expects well over $5,000 of work, so he registers with the Attorney General, shows the number on his truck and contracts, and carries the required insurance. Each township where he works may require building permits, and jobs inside Pittsburgh bring city permitting and the city registration form.

Common mistakes and how to fix them

The first mistake is paying a filing service for a "Pennsylvania general business license". The state does not issue one, and the Department of State says so. Spend the money on the filings that do apply.

The second is trading under a name like "Smith & Sons" without registering. Because adding words to your surname makes the name fictitious, many family businesses fall into this without realising. If it happens, register now; until you do, you cannot sue in Pennsylvania courts to collect on contracts made under that name.

The third is assuming the sales tax license lasts forever. It renews only if your filings are current, so file every return on time, including zero returns.

The fourth is forgetting the municipality. Pennsylvania's local taxes and registrations are where most surprises come from, especially for businesses that move between townships. A contractor or mobile service should ask each municipality it works in about registration and local taxes.

The fifth is ignoring the new annual report because the fee is only $7. Entities that miss it face administrative dissolution from 2027, and reinstatement costs far more than filing on time.

What to do next

Decide on your structure with our Pennsylvania LLC guide, check the name with the LLC name checker, and register any fictitious name before you print signs. If you sell taxable goods or services, register in myPATH and use our sales tax calculator to price at 6%, or the higher Allegheny and Philadelphia rates. Then call your municipality about local registration and taxes. If you are in Philadelphia, continue with our Philadelphia business license guide; for other states, see our business licenses overview.

Frequently asked questions

No. The state's Business One-Stop Shop says there is no general business license that all Pennsylvania businesses must obtain. What you need depends on your activity and location: a sales tax license if you sell taxable goods or services, a fictitious name registration if you trade under a made-up name, licences from state boards for regulated work, and any registrations your city, borough or township requires.
