Oklahoma is one of the easier states in which to open a small business, at least on paper. The state has no general business licence, its sales tax permit costs $20, and an LLC can be formed for $100. The complexity sits in two places: the occupations and trades the state regulates, and the cities, which license particular activities and sometimes require contractors to register before they can pull permits. This guide covers the state layer, then what Oklahoma City and Tulsa require, with worked examples and the 2026 fees checked in October 2026.

Quick answer

Oklahoma has no general state business license; the Department of Commerce says none is needed to start or own a business. If you sell taxable goods, you need a sales tax permit from the Oklahoma Tax Commission for $20. Regulated occupations need a state licence, and Oklahoma City and Tulsa license only listed activities, though every contractor in Oklahoma City must register with the city.

  • Sales tax permit: $20, plus $10 per extra location

  • State sales tax 4.5%; 8.625% in Oklahoma City (Oklahoma County)

  • Trade name report: $25 with the Secretary of State

  • No state general contractor licence; trades are licensed by the CIB

Does Oklahoma have a state business license?

No. The Oklahoma Department of Commerce states that there is no general licence required to start or own a business in Oklahoma. What the state does require depends on what you do. Some businesses and occupations need licences, permits or registrations before they open, and counties, towns and cities may have their own requirements on top.

In practice a new Oklahoma business deals with a handful of offices. The Secretary of State forms LLCs and corporations and records trade names. The Oklahoma Tax Commission (OTC) issues sales tax permits and registers employers for withholding through its online system, OkTAP. State boards and agencies license regulated work: the Construction Industries Board for electrical, plumbing and mechanical trades, the Alcoholic Beverage Laws Enforcement (ABLE) Commission for alcohol, the Oklahoma Medical Marijuana Authority for cannabis businesses, the State Department of Health for food establishments and many professional boards. And cities license specific activities, register contractors and enforce zoning.

The Department of Commerce points owners to the Oklahoma Business Hub for licensing requirements by industry, and its small business team takes questions directly. There is no single state database that lists every licence, so for anything unusual it is worth asking both the relevant state agency and your city.

The sales tax permit: Oklahoma's main business registration

For a shop, café, salon selling products, or online store based in Oklahoma, the sales tax permit is the filing that matters most. The Department of Commerce notes that retail sellers generally need one regardless of size. You apply online through OkTAP, and the fee set by 68 O.S. § 1364 is $20 for your first place of business and $10 for each additional location.

New permits start on probation. For the first six months the OTC watches whether you file and pay on time; if you do, the permit continues for the rest of a three-year term. After that it renews every three years with the fee. Late filing during the probationary period is the quickest way to have a permit cancelled, so file even when you made no sales.

Once registered you collect the 4.5% state rate plus city and county taxes, which in Oklahoma often add more than the state does. The combined rate is 8.625% in the Oklahoma County part of Oklahoma City and 8.517% in the Tulsa County part of Tulsa. Groceries carry a 0% state rate since 2024 but still pay local tax. Out-of-state sellers must register once their sales into Oklahoma pass $100,000 a year. Our Oklahoma sales tax guide covers rates by county, filing dates and the rules for restaurants.

If you trade under a name that is not your own or your entity's exact legal name, you file a trade name report with the Secretary of State for $25. Oklahoma does not require newspaper publication, unlike some states. The filing puts your use of the name on the public record and lets banks and suppliers connect the trading name to you, but it does not give you exclusive rights; that requires a trademark.

Sole proprietors do not need to file anything with the state to exist. An LLC files articles of organization for $100 and an annual certificate for $25 each year on its anniversary date. One change is coming: from November 1, 2026, Senate Bill 1641 requires new articles of organization to include the registered agent's email address. Our Oklahoma LLC guide covers the filing in detail, and our DBA guide compares trade name rules across states.

State licences for trades and regulated activities

The Construction Industries Board licenses electrical, plumbing and mechanical (heating, ventilation and air conditioning) work, at both the individual and contractor level. It also runs a separate registration for roofing contractors, with an extra endorsement for commercial roofing. What Oklahoma does not have is a state licence for general contracting. A builder or remodeler who does not personally perform licensed trade work needs no state licence, but must use licensed electricians, plumbers and mechanical contractors for those parts of a job and must meet city registration rules.

Other activities have their own regulators. Restaurants, food trucks and other food businesses need a food establishment licence from the State Department of Health, or from a city-county health department such as the Oklahoma City-County Health Department or the Tulsa Health Department. Alcohol sales need an ABLE Commission licence and usually a city licence too. Medical marijuana growers, processors and dispensaries need an OMMA licence, along with local zoning approval. Professions such as cosmetology, massage therapy, accounting, real estate and nursing each have a state board.

If you are unsure, start with the Department of Commerce's guidance and the Oklahoma Business Hub, then call the agency that regulates your activity. Getting a regulated licence usually takes longer than any registration, so start it first.

Oklahoma City: licences, contractor registration and fees

Searches for a "business license Oklahoma City" usually land on the city's Development Services licensing pages. The city does not issue one licence for every business. Its Licensing Office licenses a defined list of activities, and you check with that office whether yours is on it. The list includes advertising, alcoholic beverages, amusements, auction sales, charitable solicitation, coin-operated devices, commercial vehicles, day care and day camps, dry cleaning, employment agencies, food service establishments, gasoline pumps, home sharing, hotels and motels, kennels, massage establishments, mobile home parks, outdoor sellers, pawnbrokers, precious metals dealers, trash hauling, used auto dealers, used merchandise, and vehicle food sales such as food trucks and food truck courts.

Fees vary by licence. Examples from the city's page include $200 a year for a massage establishment, $110.40 a year for a hotel or motel, $80 a year for a pawnbroker and $50 for each charitable solicitation permit. Renewals need supporting documents that depend on the licence: a hotel renewal, for example, needs a current Oklahoma City-County Health Department permit and a fire inspection, and a massage establishment needs background checks.

Contractors face a rule that does not exist at state level. All contractors must register with the City of Oklahoma City, and only registered contractors can buy permits for construction work in the city. A general contractor with no state licence still needs this city registration before taking a job that needs a permit. Occupational licences for certain trades are handled separately.

The city moved its business licensing online, and new applications and renewals of expiring licences now go through its online licensing portal. The Licensing Office is at 420 W. Main St. and can be reached at 405-297-2606.

Tulsa: activity licences and trade licences

Tulsa works the same way. Its License and Collections office, part of the Finance Department, handles licences and permits for specific activities, including alarm permits, commercial animal establishments, beverage certificates of compliance, chauffeurs, coin-operated device decals, food and liquor, hotels and the Tulsa lodging tax, loading zones, outdoor sellers, pawnbrokers, recreation centres, short-term rentals and taxis. Most forms are downloaded, completed and mailed to License and Collections; food and liquor permits are applied for online through the city's permit system, and short-term rentals register through a separate portal.

Trade licences, such as those for building contractors and trades the city regulates, go through Tulsa's Development Services instead. If your business is not on any of these lists, you need no general city licence, but you still need zoning approval for the premises, building and sign permits where work is done, and a sales tax permit if you sell taxable goods.

If you hire employees

Hiring adds three state registrations, none of which is a licence but all of which the Department of Commerce lists for new employers. You register with the Oklahoma Tax Commission for income tax withholding, which you can add to the same OkTAP account as your sales tax permit. You register with the Oklahoma Employment Security Commission for state unemployment tax. And you arrange workers' compensation insurance, which the Oklahoma Workers' Compensation Commission oversees. You also need a federal EIN, which is free from the IRS. Do these before the first payroll, not after, because penalties for late withholding and unemployment reports start small and grow. Wage rules matter too: the Oklahoma minimum wage is $7.25 (most employers); $2.00 for small non-covered employers, and tipped workers can be paid $2.13 an hour in cash wages if tips make up the difference.

Home-based businesses

A home-based business in Oklahoma follows the same state rules as any other. If you sell taxable goods, your home address is the location on your sales tax permit, and you charge the rate for your city and county. The local layer is zoning: most Oklahoma cities allow home occupations within limits on signs, customer traffic, employees and outdoor storage, and some require a permit. Food made at home for sale is covered by Oklahoma's home food rules, which limit what you can make and how you can sell it, so check them before you start. A licensed occupation, such as cosmetology, may also have rules on practising from home.

Worked examples: first-year costs

A boutique in Oklahoma City. Keisha forms an LLC for $100, files a $25 trade name report for "Plaza Thread Co." and gets a $20 sales tax permit. Her state setup costs are $145. Clothing retail is not on Oklahoma City's licensed list, so she needs no city licence, only zoning approval and a sign permit. A $50 dress sold in the Oklahoma County part of the city carries 8.625% tax, which is $4.31. She files her first returns on time to clear the six-month probation, and pays the $25 annual certificate each year.

A food truck in Tulsa. The owner gets a sales tax permit, a food licence and inspection from the health department, and the city's food permit through Tulsa's online system. If the truck also sets up in Oklahoma City, it needs that city's vehicle food sales licence and a second set of local approvals, because each city licenses separately.

A remodeler in Oklahoma City. Dan has no state licence, because Oklahoma does not license general contractors, but he must register with the city before he can buy a building permit. He hires a CIB-licensed electrician and plumber for those parts of a kitchen remodel. If he sells and installs materials, he checks with the OTC how his contracts are taxed and whether he needs a sales tax permit.

Common mistakes and how to fix them

The first mistake is missing returns during the probationary period. A new permit holder who files late in the first six months risks losing the permit. File a zero return when you have no sales, and set reminders for the 20th of each month.

The second is assuming that no state contractor licence means no registration at all. In Oklahoma City, an unregistered contractor cannot buy a permit, and work without a permit can be stopped. Register with each city where you work.

The third is buying an existing business and keeping the seller's permits and licences. A new owner should register for its own sales tax permit on OkTAP rather than rely on the seller's account, and should ask the city whether its licences must be applied for again after a change of ownership.

The fourth is treating a trade name report as brand protection. It records your name but does not stop anyone else using a similar one. Search the trademark registers if the brand matters.

The fifth is opening before the health or alcohol licence is issued. Inspections and approvals take weeks, and a business that opens early can be fined or delayed further. Apply for regulated licences before signing a long lease.
