Meghalaya rewrote its professional tax in 2022. The old schedule — twelve income bands starting at just ₹50,000 a year — was removed from the Act, registration became compulsory, prison terms gave way to fines, and late payment started to carry interest. Many payroll websites still show the old table, so employers in Shillong, Tura, Jowai and Nongpoh can easily over-deduct. This guide is for employers, HR teams, traders and professionals in Meghalaya. It explains what the 2022 law and the 2023 rules say, the reported slabs, who collects the tax in State and District Council areas, registration and enrolment, dates, penalties and worked rupee examples — and it is clear about the one thing we could not confirm from an official source.

Quick answer

Meghalaya's professional tax is charged on annual gross income. Since 2022, rates are notified by the State Government; as reported when the change was approved, income below ₹1.8 lakh a year is exempt, and the tax is ₹500 a year, ₹1,000 a year, ₹1,500 a year or ₹2,500 a year a year above that. Late payment carries 12% a year interest.

  • Law: Meghalaya Professions, Trades, Callings and Employments Taxation Act (Assam Act VI of 1947 as adapted), amended by Act 15 of 2022

  • Employers register in Form IA within 90 days; individuals enrol in Form IIA

  • Pay by the last day of the month after each quarter to avoid interest

  • We could not find the rate notification online — confirm the current schedule with your tax circle

What changed in 2022

Meghalaya inherited Assam's 1947 professional tax law and adapted it. Until 2022 the rates sat in a Schedule to the Act, last replaced from 1 April 2012 by Meghalaya Act 6 of 2012: nil up to ₹50,000 of gross annual income, then eleven more bands rising to ₹2,500 above ₹5 lakh.

In August 2022 the Governor promulgated Ordinance No. 7 of 2022, and the Legislative Assembly replaced it with the Meghalaya Professions, Trades, Callings and Employments Taxation (Amendment) Act, 2022 (Act No. 15 of 2022). It received assent on 23 September 2022, was published in the Gazette on 27 September 2022 and came into force at once. Its main changes:

  • Section 3A — every employer liable to pay tax must obtain a certificate of registration, and every person paying for themselves a certificate of enrolment.
  • Section 4 — "the tax shall be levied at the rates as may be notified by the State Government from time to time". The old Schedule was omitted.
  • Section 12(5) — interest of 12% a year if a registered person fails to pay by the last day of the month following the quarter, unless at least 90% of the tax was paid by the due date.
  • Section 15(3) — the old punishment of up to six months' imprisonment or a ₹500 fine was replaced by a fine of four times the tax sought to be evaded, after a hearing.
  • Additional and Joint Commissioners of Taxes were added as authorities.

The implementing rules came in a notification of 18 January 2023 (ERTS (T) 122/2021/Pt I/33), which inserted the registration and enrolment procedure, new forms, interest and penalty procedure, and named megtaxation.nic.in as the portal for online procedures.

Meghalaya professional tax slab for 2026

Because section 4 now leaves rates to notification, the current schedule is in a government notification rather than the Act. We searched the Taxation Department's acts, rules and notifications pages and the state portal and could not find that rate notification online. The figures below are the four bands reported when the state cabinet approved the change in 2022, which payroll references in 2026 also use. They are consistent with the Act's intent and the ₹2,500 a year constitutional ceiling, but treat them as reported figures until you see the notification.

Annual gross incomeProfessional tax for the yearMonthly salary equivalent
Below ₹1.8 lakh a yearNilUp to about ₹15,000
₹1,80,000 to ₹3,00,000₹500 a year₹15,000–₹25,000
₹3,00,000 to ₹5,00,000₹1,000 a year₹25,000–₹41,667
₹5,00,000 to ₹7,50,000₹1,500 a year₹41,667–₹62,500
Above ₹7,50,000₹2,500 a yearAbove ₹62,500

The 2023 rules confirm the basis: employers' and taxpayers' returns work out "the total tax payable … with reference to the total annual gross income as specified in the Schedule notified by Government". Meghalaya therefore taxes gross annual income, not monthly salary — an important difference from Assam, which still uses monthly salary slabs (see our Assam guide).

At the boundaries the reports are not precise about whether, say, exactly ₹3 lakh falls in the lower or higher band. The difference is ₹500 a year; if an employee sits exactly on a boundary, ask the circle office how it reads the notification and record the answer.

Who has to pay and who collects it

The Act taxes every person engaged in a profession, trade, calling or employment in Meghalaya: salaried employees, professionals, traders, firms, companies and others. Since the old Schedule — with its separate entries for lawyers, doctors, dealers and companies — was omitted, the notified schedule is the reference for every class. The reported four-band structure is based on gross income, so it applies to self-employed people on their gross income as well as to employees.

State or District Council? Much of Meghalaya is a Sixth Schedule area governed by the Khasi Hills, Jaintia Hills and Garo Hills Autonomous District Councils. The 2023 rules recognise assessing authorities in "areas under the jurisdiction of the State Government or the Autonomous District Councils". If all your places of work are within one jurisdiction, you apply to the authority for your principal place of business. If they are spread across State and District Council areas, you file separate applications to each authority for the places of work in its area. The 2022 reports said registration in scheduled areas would be done by the District Councils, and in non-scheduled areas by the Taxation Department.

Diplomatic staff. Indian citizens employed by a foreign diplomatic or consular office or trade commission in Meghalaya must enrol and pay the tax themselves.

Registration and enrolment

Employers — Form IA. Under section 3A(4)(a), an employer must apply within 90 days of becoming liable. The application in Form IA must attach Form Ia: a list of proprietors, partners, directors and employees with their designation, estimated gross annual income and estimated annual tax. Additional establishments get their own Form Ia. If the application is in order, the assessing authority issues the certificate in Form IAA within thirty days. If something is missing, the authority must say so within seven working days in Form IAB, and you have seven working days to reply. Display the certificate at your principal and every additional place of work.

Individuals and self-employed — Form IIA. Professionals, traders and others paying for themselves apply for enrolment in Form IIA, along with a receipted proof of payment of the tax. One enrolment certificate (Form IIAA) covers all your places of work in the state, and the authority must decide within seven working days.

Online. The Taxation Department's site, megtaxation.nic.in, links "Application for Registration in Professional Tax (for Establishments)" and "Application for Enrolment in Professional Tax (for Individuals)" through the Invest Meghalaya single-window portal, and tax is paid through megepayment.gov.in. Two October 2024 notifications say renewal of a professional tax registration is not required, and the final registration certificate will be issued within one working day of the application.

Changes and closure. Amendments are applied for in the same form as the original. If you stop being an employer or self-employed — or a registered person dies — you or the successor must apply for cancellation within sixty days (Form IAE or IIAE). Lost certificates are replaced on Form IAD or IIAD.

Getting compliant in Meghalaya

  1. 1

    Register or enrol

Employers: Form IA with the Form Ia employee list, within 90 days. Individuals: Form IIA with proof of payment.

  3. 3

    Work out each employee's tax

Use estimated annual gross income and the notified schedule — nil below ₹1.8 lakh a year.

  4. 4

    Deduct and pay each quarter

Deduct from salary and pay by the last day of the month after each quarter to avoid 12% a year interest.

  5. 5

    File the annual return

Employers file Form IV for the financial year with the challans and the updated employee list.

Deduction, payment and returns

The principal Act's section 9 makes the "principal officer" of an employer — a government office, local authority, company, firm or association — deduct the tax from employees' salary at source and pay it to the state. Under the proviso to section 7(1), an employee whose tax is deducted this way does not have to file a separate return. Someone who offers to pay at the highest rate also need not file a return or produce evidence of income.

When to pay. The 2022 amendment links interest to a quarterly cycle: a registered person who fails to pay "on or before the last day of the following month of the quarter next" owes interest. In practice, deduct monthly or quarterly and pay by 31 July, 31 October, 31 January and 30 April for the four quarters. If at least 90% of the tax due is paid by then, no interest is charged on the shortfall.

Returns. The 2023 rules require employers to file an annual return in Form IV for each financial year, and other registered taxpayers a return in Form I, with receipted challans attached, by the due date in rule 10. The department's copy of the 1947 rules puts that at sixty days from the start of the financial year — about 30 May. At the time of the return the employer also furnishes the updated list of employees with estimated income and tax.

Rule 41 says the online procedures for registration, enrolment, return and payment are valid "from a date to be notified". Registration and payment are online already; if your circle still accepts paper returns, keep the acknowledgement.

Worked examples in ₹

Example 1 — an office assistant in Shillong. Daniel earns ₹14,000 a month, ₹1,68,000 a year. That is below ₹1.8 lakh a year, so nothing is deducted. Under the 2012 schedule he would have paid ₹750 a year — one reason the 2022 change mattered.

Example 2 — a schoolteacher in Tura. Ms Marak earns ₹32,000 a month, ₹3,84,000 a year, in the ₹3–5 lakh band: ₹1,000 a year a year. Her school deducts ₹250 a quarter and pays by the end of the following month.

Example 3 — a Shillong hotel with 30 staff. Eighteen staff earn under ₹15,000 a month (nil). Eight earn ₹18,000–₹24,000 (₹500 a year each), three earn ₹30,000–₹40,000 (₹1,000 a year each) and the manager earns ₹70,000 (₹2,500 a year). Annual tax: 8 × ₹500 + 3 × ₹1,000 + ₹2,500 = ₹9,500, or ₹2,375 a quarter. Paying ₹2,200 by the quarter's deadline (over 90%) avoids interest on the shortfall, but the remaining ₹175 still has to be paid.

Example 4 — a late payment. The same hotel pays one quarter's ₹2,375 three months late. Interest at 12% a year for three months is about ₹71.

Example 5 — a chartered accountant in Jowai. Gross professional income of ₹9 lakh puts him in the top band: ₹2,500 a year a year. He enrols in Form IIA with proof of payment, applying to the authority for the Jaintia Hills area where his office is.

Our free salary slip generator can show the professional tax line on each payslip so employees can check it against the notified band.

Penalties, interest and assessment

  • Interest (section 12(5), rule 39): 12% a year for the period of default when tax is not paid by the last day of the month after the quarter, with the 90% safe harbour.
  • Fine for evasion or non-compliance (section 15(3)): four times the tax sought to be evaded, in addition to the tax and interest. Under rule 40 the officer first issues a notice in Form 11; you have twenty-one days to reply, and the order comes in Form 12. No such notice can be issued after three financial years from the assessment year.
  • Rejected application: an applicant whose registration or enrolment is refused after a speaking order is treated as having broken the Act and can face section 15 proceedings — so answer deficiency notices within the seven working days.
  • Appeals: the memorandum of appeal is in Form 10; refunds are claimed in Form VIII A.

Common mistakes and how to fix them

Using the 2012 table. It started taxing at ₹50,000 a year and had twelve bands. Payroll systems still running it are over-deducting from almost everyone earning under ₹1.8 lakh. Switch to the current schedule and refund excess deductions through payroll.

Treating Meghalaya like Assam. Assam's April 2025 slabs are monthly (nil up to ₹15,000 a month, then ₹180 and ₹208). Meghalaya's are annual and gross-income based. The nil point is similar, but the amounts above it are not.

Registering with the wrong authority. A business in a District Council area that registered only with the State, or one with branches in both, should check the rules on separate applications.

Not registering at all. Before 2022 many small employers never registered. Section 3A now makes it compulsory, and evasion can cost four times the tax. Register now and pay any arrears with interest.

Forgetting cancellation. A closed shop that never applied to cancel keeps generating notices. Apply within sixty days of closure.

Staff in other states and income-tax treatment

Professional tax follows the place of work. A Shillong business with staff in Guwahati applies Assam's monthly slabs; staff in Agartala follow Tripura's ₹150 and ₹208 monthly rates. Our due dates table puts every state side by side, and the state-wise professional tax guide covers the common rules.

Employees can deduct professional tax paid from salary income only under the old income-tax regime; a business can claim its own professional tax as an expense.

What to do next

Ask your tax circle for the current notified rate schedule and file it with your payroll records, check that every place of work is registered with the right authority, and set reminders for the four quarterly payment dates. Setting wages for the year? Check the Meghalaya minimum wages first.

Frequently asked questions

Since 2022 the rates are notified by the State Government rather than written in the Act. As reported when the cabinet approved the change, annual gross income below ₹1.8 lakh a year is exempt; ₹1.8–3 lakh pays ₹500 a year, ₹3–5 lakh ₹1,000 a year, ₹5–7.5 lakh ₹1,500 a year and above ₹7.5 lakh ₹2,500 a year. Confirm the notified schedule with your tax circle.
